Statement of the Action and Solidarity for the Empowerment of Teachers (ASSERT) condemning the latest assault by elements of the Presidential Security Group, the Pasig police and the DepEd/ULTRA security personnel on Teachers’ right to free expression and peaceful assembly during last October5 celebration of “World Teachers’ Day” We, the 32,000- strong Action and Solidarity for the Empowerment of Teachers (ASSERT) strongly condemn the latest assault by uniformed and civilian elements of the Presidential Security Group, the Pasig police and the DepED/ULTRA security force on what otherwise was a peaceful and orderly demonstration of solidarity by its members during last October 5 celebration of “World Teachers ‘ day” at ULTRA, Pasig City. The unfortunate incident happened minutes after about ten (10) of our members from Pasay, Pateros, Quezon City and National Secretariat had positioned themselves on one side of the stadium allowing free ingress and egress and wearing ASSERT identification t-shirts to greet thousands of teacher delegates from the 3 regions of CALABARZON, Central Luzon and the National Capital Region with placards the size of a coupon bond. Their placards read: “Save Philippine Education, save the Filipino teachers, save our children’s future”, “Implement the Magna Carta Now”, Upgrade the Salary Grade of Teachers to Salary Grade 20”, “ 6- working hours for Teachers, Implement now”, “ Education Budget dagdagan”, “ Reform GSIS Now”, slogans too civil, so we think, to deserve the kind of treatment accorded so-called “enemies of the State” during the dark days of the ousted dictatorship. Wasting no time and without warning, uniformed policemen immediately cordoned off our members separating them into two groups and shut them off from public view as plainclothes security agents confiscated their placards. So, our teachers decided to distribute leaflets instead containing ASSERT’s commemorative statement for the significant event. The statement explained the reason why October 5 was designated as World Teachers Day i.e. to commemorate the signing by the Special Inter-governmental Conference in Paris of the UNESCO/ILO Recommendations Concerning the Status of Teachers in 1966. That many of the recommendations that were adopted in the Magna Carta of 1966 have not been implemented. That our teachers would like to address these concerns not only to Sec. Bro. Luistro but to all stakeholders in education in response to PNoy’s call for public-private partnership. The security personnel at the inner gates were not tolerant either. They inspected the bags of teachers for leaflets which they confiscated in earnest like what the dreaded MISG did to Mrs. Aquino and her children when making visits to Bicutan during early years of Martial law. Three of our teacher-leaders ( Carmelita Del Rosario, Romeo Masagca of Pateros, and Olivet Nepomuceno of Pasay were compelled to take off their T-shirts with “Stop Commodifying Education, Defend Free Public Education” printed on them before being allowed entry to the stadium to participate in the half-day commemorative program. One plastic bag of similar ASSERT T-shirts, tarpaulins and banners reserved for the afternoon’s “ Jog For Teachers’ Rights and Welfare” 4pm activity were also ordered deposited at the guard’s post by DepEd’s Chief of Communication and negotiator Mr. Kenneth Tirado who could not account for them later on when demanded by ASSET saying the PSG took them. If our security and education officials could not even respect rights so basic as freedom of expression and assembly that our fundamental law bestows upon our teachers as citizens of this republic, then how could we expect them to implement a special bill of rights like the Magna Carta that has been honored more in the breach than in compliance for the last 44 years since its enactment? This is what the Action and Solidarity for the Empowerment of Teachers (ASSERT) say of PNoy’s education reform program as the President wrapped- up his first 100 days in office. The 32,000 –strong national organization of teachers said that so much has been said about K+ 12 or the plan to introduce kindergarten and add two more years to the present ten-year public basic education cycle. “ Nothing is clear, however, where the plan is taking us to in the light of our people’s aspiration for a self-reliant and sustainable economy that rely heavily on the full development of the country’s natural and human potential”, said James Pagaduan, ASSERT National President. K+12 is PNoy’s centerpiece program to address the twin problem of deteriorating quality of Philippine education and the alarming number of school children dropping out of school every year, with grades 1 to 3 being the hardest hit. As in the past administrations, the plan will have to rely less and less on government funding and more and more on the private sector for support under the voluntary and institutionalized system of public-private partnership that the President advocated in his inaugural speech. “Private sector supporting public education is not a bad thing, government’s deliberately abandoning its moral and constitutional duty of providing free and relevant education to its citizens is”, clarified Pagaduan Pagaduan expressed alarm in particular, over what he sees as the increasing role given the private sector in policy review and reorientation, planning, monitoring and evaluating DepEd program and projects. T5hese programs and projects, Pagaduan elaborated, include review and revision of curriculum, writing, production and distribution of textbooks, teachers’ recruitment, scholarships and training, procurement, staff appraisal, etc. Instead of allocating the highest priority to education as mandated by the 1987 Philippine Constitution, Pagaduan lamented, government choose to follow the impositions of World Bank and other foreign lending institutions to cut public expenditures in exchanged for new loans and foreign assistance. The undue advantage given private sector has, according to Pagaduan, de- emphasized social science as a course and subject in both basic and higher education curricula, marginalized teachers’ cooperatives and other well- meaning education service providers among NGOs and POs and promoted crash commercialism and consumerism among school children. He also lamented how, easily representatives of the big business, banking and corporate sectors get elected to Congress, chair important committees and sit in the governing boards of state colleges and universities to influence policy and legislations that favor corporate greed for profit.# Baguio 2010 Teachers’ Month Campaign and World Teachers Day: “My Teacher, My Hero” Brief History and Background The celebration of World Teachers’ Day started on October 5, 1994. Since then, this has been celebrated annually across the globe. This event took off from the UNESCO / ILO (International Labor Organization) “Recommendation concerning the Status of Teachers” adopted by the Intergovernmental Conference on October 5, 1966. This Recommendation, for the first time ever, gave teachers, throughout the world, an instrument that defined their responsibilities and asserted their rights. On October 5, 1994, UNESCO inaugurated World Teachers’ Day. World Teacher’s day aims to mobilize support for the teachers across the world and ensure that the needs of future generations are efficiently met by them. The day seeks to acknowledge the dedication and commitment of the teachers of the world towards their profession. Teachers’ Month Campaign in the Country Teachers’ Month Campaign in the country started in 2008 through the participation of key business, academic institutions and private organizations on education. LESS than two weeks after President Arroyo certified it as urgent, the House of Representatives, in plenary session, approved on Wednesday night Joint Resolution 36 that would upgrade, rationalize and standardize compensation of all government employees.
Under the resolution the salary adjustment for State workers will be implemented first on July 1 and will be given in four tranches from 2009 to 2012.
House leaders said the program applies to all civilian government personnel, regardless of status. Military, police and other uniformed personnel are covered by a separate compensation system provided for under a substitute resolution to Joint Resolution 24.
They reiterated that the salary adjustment prescribed for the incumbent President, Vice President and members of Congress shall take effect only after the expiration of their terms.
Arroyo’s certification of the measure’s urgency made possible the simultaneous approval on second and final reading by the chamber in plenary session, Speaker Prospero Nograles said.
Under the resolution, the initial implementation shall be charged from the 2009 national government budget and from the savings of the different agencies. The succeeding tranches shall be included in the annual general appropriations act.
Besides the executive, legislative and judicial branches, those covered include the constitutional commissions, state universities and colleges, government-owned and -controlled corporations (GOCCs), government financial institutions and local governments (GFIs).
As for the GOCCs and GFIs, the amount needed shall be charged against their respective corporate funds.
All positions in the government shall be grouped into three categories, namely subprofessional or positions involved in manual or clerical work in support of office operations, or those engaged in arts, crafts and trades; professional or positions involved in the exercise of profession or application of knowledge acquired through formal education and training and executive or managerial positions involved in the executive, legislative and judicial functions.
In the proposed salary schedules, the present 33 salary grades and eight steps per salary grade shall be retained. The differences, however, between salary grades shall be rationalized to avoid overlaps.
Thesystem also follows the principle of “nondiminution of benefits.”
Government agencies authorized by law to have their own compensation and position classification system shall be governed by their respective own systems.
In addition to the resolution, the House, which adjourns sine die on June 5, also approved on third reading 57 local bills, eight local measures on second reading, adopted the Senate version of House Bill (HB) 3618 or the National Police Education Requirement Bill and approved the Conference Committee report on Senate Bill 2396 and HB 4237 or the Magna Carta of Women.
It also concurred with the Senate amendments on four other local bills on education, the judiciary and grants of franchises.
RESOLUTION APPEALING TO ALL MEMBERS OF THE HOUSE OF REPRESENTATIVES TO REJECT JOINT RESOLUTION NO. 24 GIVING THE PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES AND THE DEPARTMENT OF BUDGET AND MANAGEMENT EXTRA LEGISLATIVE AND QUASI-JUDICIAL POWERS IN THE IMPLEMENTATION OF THE COMPENSATION AND POSITION CLASSIFICATION SYSTEM IN THE GOVERNMENT FOR BEING AGAINST THE INTEREST OF OUR 1.2 MILLION GOVERNMENT WORKERS AND TEACHERS
Whereas, Joint Resolution No. 24 sponsored by House Speaker Prospero Nograles of Davao City and providing for a four-year 8 percent yearly increase in the monthly pay of rank-and-file government workers was filed in contention with House Bills 4734 and 5213 proposing, on the other hand, a Php 3,000 yearly salary increase for public school teachers in three years starting 2009;
Whereas, said joint resolution has been introduced to be the third in a series of government moves (R.A. 6758 in 1989 and Joint Senate-House Resolution No. 1 in 1994) to standardize the pay and position classification system in the public sector including those in government-owned and-controlled corporations (GOCCs) and government financial institutions (GFIs);
Whereas, the ambiguous wordings and phraseology of the first two salary laws and their confiscatory interpretative implementation by the DBM have been the source of protracted court battles, disappointments and demoralization of many government workers as they failed to deliver the promised relief that said laws envisioned;
Whereas, Joint Resolution No. 24, in its present form and substance, aims not only to peg government workers and teachers’ pay at below poverty levels, reduce and eventually abolish existing hard-won benefits, legalize contractualization, job insecurities and precarious conditions of work but also to leave, but this time, everything to Malacañang and DBM to implement, interpret, and decide all controversies arising from the resolution’s ambiguous provisions, including the authority to amend and modify existing general and special laws;
Whereas, such delegation of extra-legislative power to the President and DBM by our lawmakers who are constitutionally mandated to exclusively exercise such power will not only violate the principle of separation of powers enshrined in our Constitution but will also be tantamount to an abandonment of their sworn duties and serious betrayal of those who elected them to office;
Whereas, a similar delegation by way of Joint Senate-House Resolution No. 1 in 1994, though did not yet include the power to amend or modify existing laws, still has enabled a scheming DBM to under-implement at will what would have been a 4-year salary increase in 4 equal tranches into a 4-year pay hike in 5 unequal tranches – a clever move that has robbed all public school teachers of significant sums in this wise;
